Conditions of Sale
Each Berner’s Auction Gallery auction is conducted under the terms announced with that sale. By registering to bid, in person or online, you accept those terms together with the conditions below.
Buyer’s premium
A 26% buyer’s premium applies to all credit-card purchases, or 23% if paid by cash or check; the buyer’s premium is part of the total purchase price. Invoices greater than $1,000 require payment by cash, certified check, bank check or wire transfer.
Warranties
All items are sold “AS IS, WHERE IS” with all faults. Neither Berner’s nor the consignor makes any warranty or representation as to merchantability, authenticity, age, condition or value. Written and oral descriptions are our opinions and are not a guarantee. Antiques carry honest wear from age and use. All items are available for examination before the sale; by bidding you signify that you have examined the lots as fully as you desire. We do not give refunds — all sales are final.
Storage & removal
All items must be paid for before removal, and the purchaser assumes responsibility at the fall of the hammer. Property should be removed no later than 4:00 PM on the fifth business day following the auction; items not removed by then are subject to storage and handling fees.
Sales tax & firearms
All sales are subject to Ohio and Clark County sales tax unless a valid tax-exemption certificate is on file. Berner’s follows all Federal Firearms Regulations. The auctioneer is licensed and regulated by the Ohio Department of Agriculture, Auction Division.
Payment
We accept cash, certified check and bank transfer, and Visa, MasterCard, American Express and Discover with proper identification. The card used to register is charged upon completion of the auction unless you notify us of a different method.
